By providing your contact information, you consent to receive communications from us electronically — including by email, phone, and, where you have opted in, text message (SMS/MMS) — and you agree that electronic communications satisfy any legal requirement that such communications be in writing.

To the fullest extent permitted by law, our total aggregate liability for any claim arising out of or relating to these Terms or the site will not exceed one hundred U.S. dollars (USD $100). Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

You agree to indemnify, defend, and hold harmless ResiBrands, its brands, affiliates, franchisees, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to your use of the site, your submissions, your violation of these Terms, or your violation of any applicable law or the rights of any third party.

These Terms and any dispute arising out of or relating to them or the site are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to the arbitration provision below, you agree that any action shall be brought exclusively in the state or federal courts located in Travis County, Texas, and you consent to the personal jurisdiction of those courts.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS. Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or your use of the site that cannot be resolved informally shall be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, rather than in court, except that either party may bring an individual claim in small-claims court.

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND RESIBRANDS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. YOU AND RESIBRANDS WAIVE ANY RIGHT TO A JURY TRIAL. This arbitration provision does not apply to disputes governed by franchise-specific laws that require a different forum, and nothing here limits any non-waivable rights you have under applicable law.

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ResiBrands regarding the site and supersede any prior agreements. You may not assign these Terms without our written consent; we may assign them freely. Headings are for convenience only.

We may update these Terms of Service from time to time. When we do, we'll revise the date at the top of this page. Continued use of the site after changes means you accept the updated terms.
